Terms & Conditions

1. Introduction

These Terms and Conditions outline the agreement between Driven by Design and the Client for graphic design & marketing services. By engaging our services, the Client agrees to the following terms;

2. Scope of Work

The Designer agrees to provide graphic design services as outlined in the project proposal or contract. Any additional work requested beyond the agreed scope will be subject to additional charges.

3. Payment Terms
 

• A non-refundable deposit of 20% is required before work commences.

• The remaining balance is due upon project completion, prior to the delivery of final files - 7 day terms.

• Late payments may incur a late fee per month.
   

4. Revisions and Approval
 

• The Client is entitled to 3 rounds of revisions for project based requirements. Additional revisions will be charged at the agreed hourly rate. Alternatively only the hourly rate is charged if deemed appropriate.

• Once final approval is given, any further changes will be charged at the hourly rate.
   

5. Ownership and Copyright
 

• The Designer retains ownership of all preliminary work and concepts.

• Upon full payment, the Client receives the rights to the final approved design.

• The Designer reserves the right to display completed work in their portfolio and marketing materials.
   

6. Cancellation Policy
 

• If the Client cancels the project after work has commenced, all completed work remains the property of the Designer.

• The deposit is non-refundable, and any work completed beyond the deposit amount will be invoiced accordingly - payable within 7 days.
   

7. Client Responsibilities
 

• The Client agrees to provide all necessary content, materials, and feedback in a timely manner.

• Delays caused by the Client may result in an extended timeline or additional fees.
   

8. Liability and Indemnification
 

• The Designer is not responsible for any loss, damage, or legal disputes arising from the use of the designs.

• The Client agrees to indemnify and hold the Designer harmless from any claims related to the use of the final designs.
   

9. Confidentiality

Both parties agree to keep confidential any sensitive business information shared during the project.

10. Agreement

By engaging the DBD's services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
